The Affordable Care Act
As an Applicable Large Employer (ALE), compliance with the Affordable Care Act (ACA) is essential, including the provision of minimum essential coverage to your employees. Failure to comply can result in significant penalties, which can be avoided by adhering to the required standards. We offer guidance to help you navigate ACA complexities and ensure your business remains compliant.
ACA Penalty A & B 2026 Update:
4980H(a) Penalty: If an applicable large employer (ALE) does not offer Minimum Essential Coverage (MEC) to at least 95% of full-time/full-time equivalent employees and their dependents, the penalty is $278.33 per month per employee ($3,340 annually), minus the first 30 employees.
4980H(b) Penalty: If an employer does offer coverage, but it is not affordable or does not provide minimum value, and at least one employee receives a Premium Tax Credit (PTC) through the Exchange, the penalty is $417.50 per month per impacted employee ($5,010 annually)

Mr. Guevara began his career in 2013 and brings over a decade of experience delivering ACA-compliant, cost-effective benefits solutions for employers and brokers.
In 2023, he founded Pacific Group Benefits to break away from large, impersonal agencies and provide personalized employee benefits through innovative plan design, strong carrier partnerships, and service, helping businesses reduce healthcare costs while maintaining ACA compliance and supporting individuals and families with Medicare, Life Insurance, and other financial solutions.
